Dealing with a problem

In the event of any dispute arising from, or in connection with, these Terms (Dispute), the party claiming there is a Dispute must give written notice to the other party setting out the details of the Dispute and proposing a resolution. Within 7 days after receiving the notice, the parties must, by someone with authority to reach a resolution, meet at least once to attempt to resolve the Dispute or agree on the method of resolving the Dispute by other means, in good faith. All aspects of every such conference, except the fact of the occurrence of the conference, will be privileged. If the parties do not resolve the Dispute, or (if the Dispute is not resolved) agree on an alternate method to resolve the Dispute, within 21 days after receipt of the notice, the Dispute may be referred by either party (by notice in writing to the other party) to litigation. Nothing in this clause will operate to prevent a party from seeking urgent injunctive or equitable relief from a court of appropriate jurisdiction.

If a part of these Terms isn’t right

If a provision of these Terms is held to be void, invalid, illegal or unenforceable, that provision must be read down as narrowly as necessary to allow it to be valid or enforceable. If it is not possible to read down a provision (in whole or in part), that provision (or that part of that provision) is severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms.

Which laws govern these terms of use

If you are in New Zealand and a consumer of products or services, you may have certain rights and/or remedies under the New Zealand Consumer Guarantees Act 1993. When a guarantee under the Consumer Guarantees Act 1993 is breached, you may be entitled to a range of remedies. At Computer Help NZ, your privacy is important to us.

We collect personal information from you, including information about your:

  • Contact Details: name, address, email address, phone numbers
  • Brief computer description
  • Repair issues
  • Interactions with us
  • Billing or purchase information
  • Passwords and usernames where required.

We collect your personal information in order to:

  • diagnose and repair computers and devices

Besides our staff, we share this information (brief computer description & repair issues) with:

  • Some 3rd party repairers in order to identify repairs that are outsourced e.g. warranty repairs.

Providing some information is optional. If you choose not to supply your contact details and passwords, we'll be unable to complete your repair.

We keep your information safe by storing your data in password protected databases and only allowing relevant staff access. We regularly shred paper documentation that contains private information.

Your data is your data. We only open files, photos or documents from your device when it is essential to the repair of your computer device. Files may need to be opened for testing purposes, where possible we will select files that seem the least sensitive.

We use cookies to better serve the way you use our website. You have the ability to accept or decline cookies in your browser. If you choose to decline cookies, you may not be able to fully experience the website. We may provide third parties (e.g. Google) with aggregated statistics about website visitors that we have generated using the cookies mentioned above. Computer Help NZ uses “Closed Circuit Television” (CCTV) capturing both sound and footage, is used in particular areas to monitor all those who enter the premises of 160b Selwyn Street. We do this in order to help reduce crime and theft, and, on the very rare occasion, to any report any criminal or violent behaviour from customers or employees.
We have signage that indicates where CCTV equipment is operating. CCTV footage will only be viewed by authorised staff and representatives from public law enforcement agencies (e.g. the NZ Police) in accordance with the purpose noted above, or when checking that the system is operational. No attempt will be made to identify individuals from CCTV footage except in cases of reported or suspected incidents requiring investigation, or in relation to any legal proceedings.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
